Zero Tolerance and Different Standards

In Louisiana, there is a zero-tolerance policy for under-21 drinking, let alone drinking and driving. The standards for determining an underage DWI are different as well. If the individual arrested blows between a .02 and a .08 into a Breathalyzer or Intoxilyzer, they can be charged with underage DWI.

A .02 equates to maybe one or two drinks. Blowing above a .08, or refusing to submit to the breath test, will be charged as an adult DWI.

Individuals under the age of 21 who register between a .02 and a .08 will automatically lose their licenses for 180 days. Louisiana law also mandates that if anyone under the age of 21 refuses to take the test, they will lose their license for 180 days. Since the same penalty is in place, our Metairie underage DUI lawyers have more leverage where our client refused the test to plead the case down to underage drinking.
